Getting a Marriage License in Livingston County

Marriage licenses are issued by the Livingston County Clerk at 335 Court St, Smithland, KY 42081. The County Clerk is Sonya Williams, and the Clerk contact page gives phone (270) 928-2162, email sonya.williams@ky.gov, and office hours Monday 8AM-5PM and Tuesday-Friday 8AM-4PM. Saturday and Sunday are closed. Both parties must apply together, and both must be 18 or older unless the published minor requirements apply.

The official Clerk page says applicants must provide identification. Acceptable forms listed in the research include driver's license, government-issued picture ID, original birth certificate, passport, or social security card. Applicants also need the correct spelling of father's full name and mother's full maiden name. How to Apply for a Marriage License

Livingston County follows the Kentucky rules published by the Clerk. There is no waiting period, blood test, or physical requirement. A license is valid for 30 days, including the date issued. It can be used anywhere in the Commonwealth of Kentucky but cannot be used outside Kentucky. If the marriage is not solemnized within 30 days, the parties must apply for a new license.

Minor and Restricted Marriage Rules

The Livingston Clerk source publishes detailed minor requirements. Both parties must be 16 years of age. If either party is under 16, a marriage license cannot be issued without an order from District Court, and the source states the bride must be pregnant before the court will issue an order. A female minor must apply in the county of her parent's residence, although she may marry in another county after completing requirements.

Consent to Marriage Form 84-FCC-501 is required for minor applicants. It must be completed, witnessed, signed by parents or legal guardian, and sworn by the Deputy Clerk. A guardian must bring guardianship documentation. One parent or legal guardian and two witnesses age 18 or older must sign for each minor. If parents are divorced, custody papers are required. The Clerk lists several prohibited or restricted marriages, including people nearer of kin by blood than second cousins, first cousins, a mentally incompetent person, a person still married to a living spouse from whom they have not divorced, marriages not solemnized or contracted in the presence of an authorized person or society, common law marriages, and proxy marriages.

After the Ceremony

Livingston County's marriage record is completed after solemnization and return of the signed paperwork. Marriages may be solemnized by clergy, justices and judges of the Court of Justice, retired justices or judges not removed for cause or convicted of a felony, county judge/executives, justices of the peace and fiscal court commissioners authorized by the governor or county judge/executive, and certain religious societies. At least two persons besides the parties and officiant must be present.

Kentucky has no residency or licensing requirements for ministers or priests who perform marriages, and authorized officiants may perform marriages anywhere in Kentucky. After the ceremony, the officiant returns the signed marriage application to the Livingston County Clerk's Office, where it is filed and a marriage license is issued to the couple. Divorce case records may include pleadings, motions, orders, final decrees, child-support entries, and other domestic case filings. Public access can be limited when a file contains protected personal information, juvenile information, confidential financial material, or sealed orders. A certified divorce decree should be requested from the court clerk rather than treated like a marriage certificate from the County Clerk.
